End User License Agreement and General Terms and Conditions (AGB)
May—30—2026

This is an agreement between you, the purchaser and licensee, and Cape Arcona Type Foundry that is controlled by Stefan Claudius and Thomas Schostok (hereafter CAPE or WE or US). For the purposes of this license, the term “Font” refers to the visual design of the typeface along with the Font Software containing all typographic elements. The definition of Font also extends to any bitmap and/or outline representations of typographic elements that originate from or are based on the Font. 

By purchasing, downloading, installing, or using, or otherwise handling the fonts, you accept the terms of this agreement. In accepting the terms of this agreement, you acknowledge understanding and complying with its terms. This agreement replaces and supersedes any previously made oral or written proposal or agreement between you and CAPE via the website www.cape-arcona.com.

You hereby agree to the following:

1. Grant of license
CAPE does not sell the font software, but grants a license to use it. You are not purchasing the copyright to the design or any other part of the fonts, but the (license) rights, meaning a non-exclusive, non-transferable, perpetual, and worldwide license, to use the fonts as specified in this agreement.

If you, the purchaser, are acting on behalf of the end user, you must ensure that the end user accepts this EULA as it is, i.e. without any alterations and/or amendments. You are not allowed to ask the end user any other price than the one offered by CAPE. 

2. License coverage
A general rule (especially for designers and agencies): Under this license, you may use the font for the purposes listed here, except for sharing it to your clients, individuals or other companies. That means in detail:

  • PRINT USE
    You may use the Font in unlimited printed materials such as leaflets, books, posters, packaging, and signage.
  • WEB USE
    You may use the Font on unlimited web domains and their subdomains per license, as long as all domains belong to your company. No limitations to pageviews. 
  • SOCIAL MEDIA USE
    You may use the Font on any social media accounts.
  • LOGO USE
    You may use the Font to create logos.
  • SOFTWARE EMBEDDING
    You may embed the Font in unlimited apps, video games, or e-books, as long as all software products belong to your company. The Font may be distributed as part of the software, but must be protected so that end-users cannot access, download, or install it outside the app.
  • HARDWARE EMBEDDING
    You may embed the Font in unlimited hardware products such as smart devices, screens, phones, or cars developed by your company. The Font may be distributed as part of the hardware, but must be protected so that end-users cannot copy or download it.
  • MERCHANDISING
    You may use the Font to produce commercial or promotional merchandise such as apparel, accessories, and packaging.
  • BROADCAST/VIDEO USE
    You may use the Font in video or film productions for broadcast, theater, or streaming.
  • CONTENT CREATION AND DESIGN APPS
    You may not embed the Font in any app, website, or service that allows third-party users to create their own content or designs using the Font. For example, embedding the Font in an online design tool – where other users can freely access and use it – is not permitted under this license. Please contact us for a special license.
  • SERVER/CLOUD USE
    You may install the Font on servers or cloud infrastructure to generate documents owned and controlled by the licensee. The restrictions of Content Creation and Design Apps apply accordingly – any server-side use that enables third parties to create content or designs using the Font is not permitted. Please contact us for a special license.

3. Restrictions
You may not:

  1. Rent, lease, sublicense, give, lend, or further distribute the Font Software, or any copy thereof, to other individuals, companies, or organisations.
  2. Modify, Adapt, translate, reverse engineer, decompile, disassemble, alter or otherwise copy the CAPE Font Software. However, you can import characters from the font software as graphic objects and edit them there as graphic objects. 
  3. Use the Font, any part of it, or any visual elements such as glyphs, outlines, or kerning data to develop, train, or improve artificial intelligence (AI) models – including generative AI or deep learning systems. However, you are allowed to use general metadata such as font names or category tags for AI training purposes, as long as this data cannot be used to reconstruct the Font Software or its visual elements.

4. Company size
Company size refers to the total number of people working for the Licensee company, including both employees and subcontractors. A subcontractor is any external party — such as an agency, a studio, or a freelance designer — who works with the fonts on behalf of the Licensee, within the use cases outlined in this license. If the person buying the license fails to fill the Licensee name and company size fields properly or purposely provides false information, the license will be considered null and won’t be refunded.

You must make sure that your license always matches your current company size – if your company grows, you need to update your license accordingly. Please contact us. CAPE can ask you at any time to show proof that your license matches your company size – you must reply within 30 days. If your company has grown beyond what your current license covers, you need to buy the appropriate license from CAPE and pay the additional costs.

5. General use

  1. The digital files downloaded to your computer contain font software that is the intellectual property of and is owned by CAPE. This non-exclusive license grants you certain rights to use the font software and is not an agreement for sale of the font software or any portion of it. Except for your right to use the font software granted by this license, all other rights, title of the font software, related trademarks and trade names are owned and retained by CAPE.
  2. Unless otherwise specified, the typeface or software represented by this contractual agreement are the intellectual property of CAPE.
  3. A font style or family include typically one or more of the following file formats: OTF, WOFF2, TTF. We cannot guarantee that this applies to all fonts. Please contact us before purchasing for more detailed information. Other formats may be offered on request.

6. General terms

“As Seen” The font software is provided as it exists at the time of purchase.

Validity
This license is valid indefinitely from the date of purchase. There is no time limit and no renewal fee.

Refund and exchange policy
Please check your cart carefully, as we are not responsible for customers licensing the wrong font. Exchanges are not possible. 

Warranty and support
We endeavour to produce our fonts to the most up-to-date technical standard. If you can prove that they do not function as promised, CAPE is entitled to cure the shortcoming. Should we fail within 30 days after your first information of curing, you may, within another 30 days, ask for a refund. After a refund, the respective license terminates with immediate effect and any further use is strictly forbidden. Statutory warranty rights apply to the extent required by German law, limited to a period of 12 months for commercial entities.

Breach of contract
This EULA is effective until terminated. If Licensee fails to comply with any term of this EULA, CAPE might terminate the EULA with 30 days notice. After any termination of the agreement, you must destroy any copies of the fonts, including your archival copies. The license fee would not be refunded in this case.

Rights reserved
All rights not expressly granted in this agreement are reserved to CAPE.

Warranties
CAPE represents and warrants that it has the right and authority to enter into this licensing agreement and that the agreed upon deliverables do not infringe any third-party intellectual property rights.

Liability
CAPE's liability is limited to cases of gross negligence or intent, and in any case does not exceed the amount you paid for your license. CAPE is not responsible for any damages arising from the use of or inability to use the Font – this includes loss of profits, business interruption, loss of data, legal fees, or any other direct, indirect, or incidental damages, even if CAPE was made aware of the possibility of such damages.

Waiver
The waiver of one breach or default hereunder shall not constitute the waiver of any subsequent breach or default.

Marketing
From the moment the use of a license is made in any way public by you, CAPE is entitled to use your company’s name, as well as other trademarks and images and videos of the use, for marketing reasons only.

Applicable law and court of jurisdiction
This agreement shall be governed by and construed exclusively in accordance with German law. Place of performance and exclusive place of jurisdiction is the location of the headquarters of CAPE. 

7. Contract Formation and Custom Licensing

  1. Webshop: The display of fonts in the webshop is an invitation to treat. A contract is formed when CAPE confirms the order or provides the download link.

  2. Custom Licenses: For licensing requests not covered by the standard webshop option(s), CAPE will provide an individual quote. A contract is formed upon written acceptance (email is sufficient) of said quote by the Licensee.

8. Right of Withdrawal for Consumers

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
However, your right of withdrawal expires immediately once we begin delivery of the digital content (fonts/software), provided that:

  • you have given your express consent to the immediate commencement of delivery before the end of the withdrawal period, and
  • you have acknowledged that you will lose your right of withdrawal upon commencement of delivery.

By completing your purchase, you confirm both of the above. Delivery begins immediately upon receipt of payment. The right of withdrawal therefore does not apply to any purchases made in the webshop.

TRIAL LICENSE
A trial font may not be used in a commercial project or given to a third party.
With a free trial license, you can use our test fonts to decide if you want to purchase a license. If you are a designer, you can also use the test fonts to make design suggestions to your customers. This license allows testing of our font software in various media. Once the work is used and deployed in a project, a full license must be purchased. Trial fonts may not be redistributed or sold. 

The trial version of the font software does NOT include the full feature set of the retail version, such as:

  • unsupported characters or glyphs
  • limited or non-existent OpenType features, including ligatures
  • limited support for diacritical characters and languages  


FREE FONT LICENSE

  1. The font is free for all non-commercial uses. If you want to use it commercial, you need to buy a commercial license.
  2. Free fonts usually contain only one file format (typically OTF). 
  3. Most – if not all – have a limited character set because, well, they are free, even if you buy a commercial license. 
  4. We do not provide any technical support for free font. You are free to try them first before buying.

Legal Licensor & Contracting party
All licenses granted by CAPE are licensed to you by Stefan Claudius & Thomas Schostok unless otherwise noted.
The contracting parties are the operators listed in the legal notice (Contact → Imprint), provided that they offer the specific product in question.
